Terms of Use
1 · Acceptance of these terms
These Terms of Use ("Terms") form a legal agreement between you and SOSW ("we", "us", "our") and govern your use of:
- Our marketing sites at last-control.com and lost-control.com.
- The Last Control player client at game.last-control.com.
- Any related APIs, services, or content we provide (together, the "Service").
By using the Service — including by submitting an email to our pre-registration form, signing into a player account, or playing the game — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2 · Who runs the service
The Service is operated by SOSW, based in Beit Dagan, Israel. You can reach us at info@last-control.com.
3 · Who can use the service
You must be at least sixteen (16) years old to use the Service. If you are under the age of majority in your country, you additionally confirm that your parent or legal guardian has reviewed these Terms and our Privacy Policy and consents to your use of the Service.
The Service is not available to anyone previously banned by us. You may not use the Service if doing so is prohibited by sanctions, export laws, or other rules that apply to you.
4 · Accounts and pre-registration
You can join the Service in two ways:
- Pre-registration — leave an email on our marketing site so we can contact you when access opens. We do not create a player account from a pre-registration alone.
- Player account — sign in to the player client using Amazon Cognito, including, optionally, "Sign in with Google".
You agree to:
- Provide accurate information when you sign up.
- Keep your login credentials and any one-time codes secure.
- Not share your account, sell it, or let anyone else use it.
- Tell us promptly at info@last-control.com if you suspect your account has been accessed by someone else.
One person may only operate one player account at a time, unless we explicitly allow you a second one (for example a publicly-disclosed alt for testing). We may merge, lock, or close duplicate accounts.
5 · Beta access
The Service is offered as a pre-release / beta. Features, mechanics, content, balance, and prices may change without notice. The world may be reset, partially or fully, at any time. The terminal reserves the right to refile. We will give reasonable notice for material changes when we can.
6 · Acceptable use
You agree not to:
- Break the law, or help anyone else do so, while using the Service.
- Harass, threaten, dox, or stalk other players or our staff.
- Attempt to gain unauthorised access to other accounts, our systems, or the systems of our service providers.
- Probe, scan, or test the vulnerability of the Service except under a written security-research agreement with us.
- Reverse-engineer, decompile, or disassemble the Service, except where the law explicitly grants you that right.
- Use scrapers, bots, headless clients, or automation that we have not approved, in a way that imposes load on the Service or extracts data we did not intend to expose.
- Upload, post, or transmit malware, exploits, or content that violates the rights of others.
- Use the Service to send spam, phishing, or other unsolicited communications.
- Resell, sublicense, or commercially exploit the Service or in-game content without our written permission.
- Sell, trade, or transfer accounts, login credentials, or in-game items for real-world value outside of the in-game systems we provide.
7 · In-game workers and content rules
Last Control is a science-fiction game about a corporate operator ("dominus") directing fictional non-human worker units in a closed industrial setting. The workers are fictional machines. They are not, and are not intended to portray, real people.
You must not use the Service to depict, name, simulate, or otherwise reference identifiable real human beings — public figures, private individuals, employees, family members, or anyone else. This includes, without limitation:
- Naming a worker, base, or in-game asset after a real person.
- Uploading photographs or recordings of real people, or images intended to resemble them.
- Using the Service to coordinate harassment of any real person.
We treat content rules as a hard floor, not a guideline. We may remove content, edit names, or suspend accounts that breach this section without prior notice.
8 · User-generated content
You retain ownership of the content you create through the Service (for example custom names, free-text fields, or messages you send), to the extent that content is original to you.
By submitting content through the Service, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, and transmit that content as needed to operate, improve, and promote the Service. You confirm that you have the right to grant this licence and that the content does not infringe anyone's rights or break any law.
We screen user-submitted text against an automated denylist and may remove or replace content that breaches these Terms. We may also preserve and disclose content where the law requires it, or where necessary to enforce these Terms.
9 · Intellectual property
The Service, including its source code, server-side logic, art, music, branding, names, and gameplay design, is protected by copyright, trademark, and other intellectual-property rights. Except for the limited rights expressly granted to you in these Terms, all rights are reserved by us and our licensors.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial use. You may not redistribute, modify, or create derivative works from the Service except where explicitly allowed.
The names "Last Control", "Lost Control", and the head-and-letter mark are unregistered trademarks of SOSW. Any third-party marks shown on the Service belong to their respective owners and appear only for identification.
10 · Virtual items, currency, and purchases
The Service uses in-game resources, currency, units, and other virtual items. These are licensed, not sold. They have no cash value, no exchange rate to real-world money, and cannot be redeemed, refunded, or transferred outside of the in-game systems we provide.
Prices, purchase options, and any in-game economy may change at any time. We are not obliged to compensate you for changes in availability or value of virtual items. If we terminate the Service or your account under these Terms, you may lose access to virtual items without compensation, except where required by mandatory law.
If we ever introduce paid purchases, additional terms will apply at the point of purchase, and the consumer-rights laws of your country continue to apply.
11 · Third-party services
The Service relies on third-party providers (Amazon Web Services, Google, Discord, and others described in our Privacy Policy) and may link to or embed third-party content. We are not responsible for those services or for content they show you. Your use of a third-party service is governed by that provider's terms.
12 · Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, if we believe in good faith that you have breached these Terms, that your use puts the Service or other users at risk, or that we are required to do so by law.
You can stop using the Service at any time. To delete your player account and the personal data tied to it, follow the instructions in section 10 of our Privacy Policy or email us at info@last-control.com.
The sections of these Terms that by their nature should survive termination — including sections on intellectual property, disclaimers, limitation of liability, indemnity, and governing law — remain in force.
13 · Privacy
Our handling of your personal data is described in our Privacy Policy. By using the Service you acknowledge the practices described there.
14 · Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that any in-game state or progress will be preserved across resets.
15 · Limitation of liability
To the maximum extent permitted by law, we (including our officers, employees, and contractors) are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or in-game items, arising out of or related to your use of the Service.
Our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you have paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars (US$100).
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law — for example, liability for fraud, gross negligence, or for death or personal injury caused by our negligence. If you are a consumer in the UK or EEA, your statutory rights are not affected by these Terms.
16 · Indemnity
You agree to indemnify and hold us harmless from and against any claim, loss, liability, damage, or expense (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your infringement of any third-party right. We may assume the exclusive defence of any matter for which you owe us indemnification, and you agree to cooperate with us in that defence.
17 · Changes to the terms
We may update these Terms when our practices change or when the law requires it. The "Effective" date at the top reflects the most recent change. For material changes, we will notify pre-registered users and active players in advance. If you continue to use the Service after a change takes effect, you are agreeing to the updated Terms.
18 · Governing law and disputes
These Terms and any dispute arising out of or in connection with them are governed by the laws of the State of Israel, without regard to its conflict-of-laws rules. Without limiting the foregoing, the Israeli Consumer Protection Law, 5741-1981, the Israeli Standard Form Contracts Law, 5743-1982, and the Israeli Privacy Protection Law, 5741-1981, apply to your use of the Service to the extent they grant you mandatory rights.
Subject to mandatory consumer-protection law, you and we agree that the competent courts of Tel Aviv-Yafo, Israel have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
If you are a consumer resident in the EEA, the United Kingdom, or another jurisdiction whose mandatory law gives you the right to bring proceedings in your home courts, that right is not affected by this section.
19 · General
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
- No waiver. Our failure to enforce any right under these Terms is not a waiver of that right.
- Severability. If any part of these Terms is held to be unenforceable, the rest stays in force.
- Assignment. You may not assign these Terms or any of your rights under them. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
- Notices. We give legal notices to you at the email address you used to sign up. You give legal notices to us at info@last-control.com.
